Waiver and License Agreement for EBT Instructor Training Participants
Waiver
In this section, the student participating in activities will be referred to as "the Participant"; the
Center for Taiji Studies will be referred to as "the Center"; and, the phrase "Instructor
Certification" will refer to the Instructor Certification program for which the approved applicant is
registering.
For good and valuable consideration, including enrollment of the Instructor Certification Program,
I, the Participant (as parent or guardian where applicable), for myself, my successors, heirs,
assigns, executors and administrators, forever unconditionally release and discharge all owner's
and sponsors of the Center and all of their affiliates, subsidiaries, corporate parents, officers,
directors, partners, employees and agents from all claims, causes of action, costs and
judgments that I now, or hereafter, may have or claim to have against the Center for personal
injuries (including death) and damages to property, real or personal, caused by or arising out of
the Participant's involvement in all activities of the Instructor Certification Program.
I further agree to and do hereby assume all risks of personal injuries to myself (or my child or
ward, as applicable), including death, and damages to my property, real or personal, caused by
or arising out of my involvement in the aforementioned School Activities.
I further agree for myself, my successors, heirs, assigns, executors and administrators, to
indemnify and hold the Center harmless from and against all claims and suits for personal
injuries, including death and damages to property, real or personal, caused by my (or my child's
or ward's, as applicable) act or omission and arising from my involvement in the aforementioned
School Activities, and from all judgments and costs recovered in said claim and suits and from
all expenses incurred in defending said claims or suits.
I further agree that photographs, pictures, slides and movies of the Participant taken or made by
the Center in connection with the Participant's involvement in the aforementioned School
Activities, or a reproduction of the same as well as the Participant's name, may in be used in any
manner by the Center, or by any person, corporation, partnership or association authorized by
the Center.
I warrant that the Participant is in good health and has no physical condition that should prevent
the Participant from participating in the aforementioned School Activities.
Certification Requirements and Licensure to use Dr. Yang Yang's Intellectual
Property
In this section, the terms "Participant," "the Center,", and "Instructor Certification" are as defined
in the waiver section above. Additionally, the term "Participant's School" refers to the
Taiji/Qigong business that is entirely owned, operated, and controlled by the Certified Instructor.
The term "Third-Party Organization" refers to any organization independent of the Participant's School.
I, the Participant, recognize that the "Center for Taiji Studies" and "Dr. Yang Yang's Evidence-
Based Taiji (EBT) and Qigong Program" are trademarks of the Center for Taiji Studies. I
understand that certification as an EBT Instructor is entirely at the discretion of the Center for
Taiji Studies, and requires:
completion of minimum training requirements
passing the performance and written examinations; and
recertification every two (2) years
I further understand that certification as an EBT Instructor affords limited licensure to use Dr. Yang Yang's name and intellectual property to advertise, and to provide Taiji/Qigong instruction within, the Participant's School only. Additional licensing, beyond instructor certification, is required to use Dr. Yang Yang's name and intellectual property to provide Taiji/Qigong instruction to any third-party organization, whether the instruction be provided at the third-party organization or to students at the Participant's School that originate from an agreement with a third-party organization.
